Terms & Conditions

These Terms & Conditions define the business relationship between Morris Peter, sole-proprietor photographer (hereafter “Photographer”) and the contracting party (hereafter “Client”). By confirming an estimate, commissioning a shoot, or otherwise engaging the Photographer's services, the Client accepts the following provisions unless a written agreement states differently.

1  Scope of Services

All services, deliverables, and usage rights are described in the written estimate or project confirmation accepted by both parties (e-mail suffices). Any work requested beyond that scope must be agreed in writing and may incur additional fees.

2  Estimates & Contract Formation

Estimates remain valid for 30 calendar days unless noted otherwise. A contract 

is formed once the Client accepts the estimate in writing (signature, e-mail, or purchase order).

3  Fees & Payment

• All prices are quoted in Swiss francs (CHF) and are net of VAT unless explicitly stated.

• Invoices are payable within 30 days of issue. Late payments may be subject to statutory interest and reminder fees.

• Travel, accommodation, rentals, assistants, and similar production costs are billed at cost unless already itemised in the estimate.
   

4  Copyright & Usage Rights

• Copyright for all photographs remains with the Photographer.

• The Client receives non-exclusive usage rights precisely as listed in the estimate (e.g. medium, territory, duration).

• Any use beyond that—such as resale, sub-licensing, extended commercial campaigns, or adaptations—requires a separate written licence and fee.
   

5  Cancellation & Postponement

Written notice is required for any cancellation or date change. The following 
percentages of the agreed project fee (excluding expenses already incurred)  become due:

 

Timing of cancellation Fee payable

• ≥ 10 calendar days before shoot 25 %

• 5 – 9 days before shoot 50 %

• < 5 days before shoot / on the day 100 %

Documented costs already incurred (location fees, rentals, travel, etc.) are payable in full, regardless of timing.

6  Liability & Force Majeure

The Photographer is liable only for direct damages caused by proven gross 

negligence or wilful misconduct, and limited to the total project fee. No liability is accepted for indirect or consequential loss (e.g. loss of profit) or for delays caused by force majeure (illness, extreme weather, equipment failure, transport disruption, etc.).

7  Confidentiality

Both parties shall treat all non-public information exchanged during the collaboration as confidential, unless disclosure is required by law.
 

8  Data Protection

Personal data is processed in accordance with the Swiss Federal Act on Data Protection (FADP). No data will be shared with third parties except where legally required or expressly authorised by the data subject.
 

9  Self-Promotion

Unless the Client requests otherwise in writing before the shoot, the 

Photographer may display non confidential images from the assignment for self-promotional purposes (website, social media, printed portfolio, awards, presentations).
 

10  Client Reference

The Client permits the Photographer to reference the Client’s name and logo in a customer list or case study. This permission may be withdrawn for future use at any time with reasonable written notice.
 

11  Governing Law & Jurisdiction

These Terms and any disputes arising herefrom are governed exclusively by Swiss law. The competent courts of Zurich, Switzerland have exclusive jurisdiction.
